The National Company Law Appellate Tribunal (NCLAT) partially upheld
the Competition Commission of India verdict of 2022. It ruled in favor of Alphabet Inc.’s parent company Google but reduced the fine based on reevaluation. 10% of the fine imposed was collected by Google.
So, pursuant to updated calculations, it submitted the revised amount of cash as ordered
that with the rest of the penalty [[calculated via the above method] unpaid within a month will be revalued which will determine how much additional tax they have to pay on an assessment
However, the NCLAT did not completely throw out the CCI’s argument.
Parts of it were left up. Only the cci order, which found that Google was Warder or even with regard to Google’s violation in accordance with Section 4(2)(b)(i3) of that provision, and in line with Section 7 (b)(27), which blocks a dominant entity from controlling key technology or from one without controlling entry for others – these were shot down.
